Terms of Service

1. Acceptance

By creating an account or using EvidenceBuilder ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What the Service does

EvidenceBuilder is a tool for Shopify merchants to generate chargeback evidence packets. It accesses your Shopify store data (orders, customers, fulfillments) via Shopify OAuth to produce PDF evidence packets on your behalf. It does not submit disputes on your behalf or communicate directly with card networks or payment processors.

3. Eligibility

You must be at least 18 years old and have authority to bind the business on whose behalf you are using the Service. The Service is intended for merchants operating Shopify stores.

4. Your responsibilities

• You are responsible for ensuring the accuracy of any information you add to evidence cases (e.g. merchant notes).
• You must not use the Service to fabricate or misrepresent evidence in a chargeback dispute.
• You are responsible for complying with Shopify's terms of service and any payment processor rules that apply to your chargeback responses.
• You must keep your account credentials secure and notify us immediately of any unauthorized access.

5. Data processing

By connecting a Shopify store, you authorize us to access and store order data (including your customers' personal data) as necessary to provide the Service. You are the data controller for your customers' data; we act as your data processor. Our handling of that data is governed by our Privacy Policy.

6. Acceptable use

You must not:

• Use the Service for any unlawful purpose or to submit fraudulent evidence.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Share your account with others or create accounts on behalf of third parties without authorization.

7. Intellectual property

The Service and its original content (excluding data you provide) are owned by EvidenceBuilder and protected by applicable intellectual property laws. You retain ownership of your data and the evidence packets generated from it.

8. Disclaimers

The Service is provided "as is" without warranty of any kind. We do not guarantee that using EvidenceBuilder will result in a successful chargeback dispute outcome. Evidence acceptance decisions are made solely by card networks and payment processors.

9. Limitation of liability

To the fullest extent permitted by law, EvidenceBuilder shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost revenue from an unsuccessful dispute. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may delete your account at any time from Account Settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, all your data is permanently deleted as described in our Privacy Policy.

11. Changes to these terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of São Paulo, Brazil, unless otherwise required by applicable consumer protection law.
